Mutual Divorce: What is It?
Mutual divorce occurs when both spouses agree to end their marriage amicably. Under Section 13B of the Hindu Marriage Act of 1955, the conditions for mutual divorce include:
- The couple no longer cohabits.
- They have lived apart for at least a year.
- Both agree that the marriage is unsustainable and should be dissolved.
- Filing the Mutual Divorce Petition: Both spouses jointly file the petition, detailed property and child-related agreements and the grounds for divorce.
- Appearing Before the Family Court Judge: Both parties must appear before the judge to attempt mediation. The court records their statements and reviews the petition and documentation.
- First and Second Motion: After the first hearing, there's a six-month cooling-off period (waivable if the couple has lived separately for 18 months). The second motion can be filed after this period, leading to the final hearing.
- Final Decision by the Court: The court issues the final decree, legally dissolving the marriage.
